These Terms of Service ("Terms") govern your use of CustomsBrokerIndex.com ("Site"), operated by CustomsBrokerIndex ("we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

CustomsBrokerIndex.com is an online directory that indexes publicly available information about U.S. Customs & Border Protection (CBP)-licensed customs brokers. We help importers, exporters, and businesses find and contact licensed customs brokers.

We are not a party to any transaction, agreement, or relationship between users of this Site and the brokers listed. Any engagement with a broker found through our directory is solely between you and that broker.

2. Directory Listings

Source of broker data

Base listing information (broker name, license number, license type, location) is sourced from CBP's official publicly available data. We make reasonable efforts to reflect this data accurately but cannot guarantee that listings are complete, current, or error-free. CBP license data may change; a listing on this Site does not independently verify that a broker's license is currently active or in good standing.

You are responsible for independently verifying a broker's credentials, license status, and suitability for your needs before engaging their services. You can verify any customs broker's license at cbp.gov.

Claimed listings

Brokers may claim and enrich their listings by adding profile content such as website, phone number, description, and specialties. This content is provided by the broker and is their sole responsibility. We do not independently verify broker-submitted profile content beyond the initial claim verification.

Listing accuracy and removal

If you believe a listing contains inaccurate or unlawful information, contact us at contact@customsbrokerindex.com. We reserve the right to correct, suspend, or remove any listing at our discretion.

3. Importer Inquiries

The inquiry form allows users to send messages directly to listed brokers. By submitting an inquiry, you authorise us to:

• Transmit your message and full contact details to the selected broker
• Display your first name and a preview of your message publicly on the CustomsBrokerIndex homepage as part of our live lead feed, to help licensed brokers identify relevant opportunities

Your email address, phone number, and full name are never shown publicly. If you do not wish your inquiry preview to appear on the homepage, do not submit an inquiry through the Site, or contact us at contact@customsbrokerindex.com to request removal.

We are not responsible for broker response times, the quality of services provided, or any outcome of your engagement with a broker. We do not screen, endorse, or guarantee the services of any broker listed on the Site.

4. Lead Marketplace

What the lead marketplace is

We display a curated feed of real importer inquiries submitted through the directory. Licensed customs brokers may purchase access to the full contact details (name, email, phone number) of an inquirer by contacting us at contact@customsbrokerindex.com.

Lead pricing

Leads are currently priced at $29 per lead. Pricing is subject to change at any time. The price displayed at the time of your purchase request is the price you will be charged.

Lead purchase process

Lead purchases are handled manually via email. To purchase a lead, email us with the lead details and we will respond with payment instructions. Full contact details are delivered to you by email after payment is confirmed.

No guarantee of lead quality or conversion

Leads are real inquiries submitted by visitors to CustomsBrokerIndex.com. However:

• We do not verify the accuracy or completeness of information provided by inquirers
• We do not screen inquirers for intent, financial qualification, or seriousness
• We make no representation that an inquirer is actively seeking to hire a broker
• We do not guarantee that a lead will result in a conversation, a meeting, or a business engagement of any kind
• Lead contact details are provided as submitted — we cannot verify that email addresses or phone numbers are accurate or monitored

You purchase leads at your own risk. Conversion depends entirely on the inquirer's intent and your own follow-up efforts.

No refunds on lead purchases

All lead purchases are final and non-refundable once contact details have been delivered to you. If you believe you were charged in error, or did not receive the contact details you purchased, contact us within 7 days at contact@customsbrokerindex.com.

Eligibility to purchase leads

Lead purchases are available only to individuals or firms holding a valid, current CBP customs broker license, or authorised representatives of such firms. By purchasing a lead, you represent that you are a licensed customs broker or an authorised representative of one. We reserve the right to refuse or cancel any lead purchase at our discretion.

Use of purchased contact details

Contact details purchased through the lead marketplace may only be used to follow up with the inquirer regarding customs brokerage services. You must not:

• Add purchased contacts to marketing lists or email campaigns without the individual's consent
• Resell or share purchased contact details with any third party
• Use contact details for any purpose unrelated to the original inquiry
• Contact the inquirer in a way that constitutes harassment or spam under applicable law

Violation of these conditions may result in your access to the lead marketplace being revoked without refund.

5. AI-Generated Content

CustomsBrokerIndex uses AI language models to generate certain content on the Site, including:

• Blog articles: Published articles on /blog/ are AI-generated and intended for general informational purposes only. They do not constitute legal, compliance, or customs brokerage advice. Information may not reflect current CBP regulations, tariff schedules, or trade laws. Always consult a licensed professional for compliance matters.
• Broker profile descriptions: Some broker profiles include AI-generated descriptions created from publicly available data. These descriptions are not reviewed or approved by the broker unless they have claimed their listing. They may contain inaccuracies and are not statements by or endorsements from the broker.

We make reasonable efforts to ensure AI-generated content is accurate and useful, but we make no warranty as to its accuracy, completeness, or fitness for any particular purpose.

6. Advertising Services

We offer paid listing tiers for licensed customs brokers ("Advertising Services"), currently including Claimed Listings and Featured Listings. The following terms apply to all paid plans.

Eligibility

Advertising Services are available only to individuals or firms holding a valid, current CBP customs broker license. By purchasing a paid plan, you represent that you are a licensed customs broker or an authorised representative of one.

Subscription and billing

• Paid plans are billed on a monthly subscription basis.
• Billing begins on the date your plan is activated.
• Subscriptions renew automatically each month unless cancelled.
• Prices are subject to change with 30 days' notice.

Cancellation

• You may cancel your subscription at any time.
• Cancellation takes effect at the end of the current billing period.
• Your listing reverts to the free tier after cancellation — it remains live.
• We do not offer prorated refunds for partial months.

Refund policy

All subscription fees are non-refundable except where required by applicable law. If you believe you were charged in error, contact us within 14 days of the charge at contact@customsbrokerindex.com.

Featured placement

Featured listings receive priority placement in relevant search results on the Site. Placement position may vary based on the number of Featured brokers in a given market. We do not guarantee a specific position, rank, or volume of inquiries. Featured placement is limited to the target markets selected at sign-up (up to 3).

Broker content responsibility

By claiming or upgrading a listing, you agree that all content you add to your profile is accurate, lawful, and does not infringe any third-party rights. You must not submit false credentials, misleading descriptions, or content that violates applicable law. We reserve the right to edit or remove profile content that violates these Terms without notice or refund.

Suspension and termination

We may suspend or terminate a paid listing without refund if:

• We determine your CBP license is inactive, revoked, or was never valid
• Your profile content is found to be materially false or misleading
• You violate these Terms in any material way

7. User Conduct

You agree not to:

• Submit false, fraudulent, or misleading information through any form on the Site
• Use the Site to spam, harass, or send unsolicited commercial messages to brokers
• Scrape, crawl, or harvest data from the Site in bulk without our written permission
• Attempt to circumvent or compromise the Site's security or functionality
• Impersonate any person, broker, or entity
• Use the Site for any unlawful purpose

We reserve the right to block or restrict access to any user who violates these Terms.

8. Intellectual Property

The Site's design, code, copy, and original content are owned by CustomsBrokerIndex and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from Site content without written permission.

Broker names, license numbers, and public location data are factual records in the public domain, sourced from CBP. Brokers retain ownership of profile content they submit (descriptions, logos, etc.) and grant us a non-exclusive licence to display it on the Site while their listing is active.

9. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. We do not endorse, recommend, or warrant the quality, competence, or suitability of any broker listed on the Site.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CUSTOMSBROKERINDEX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS, ARISING FROM YOUR USE OF THE SITE OR ANY BROKER ENGAGEMENT INITIATED THROUGH IT.

Our total liability for any claim arising from use of the Site or Advertising Services shall not exceed the amount you paid us in the 3 months preceding the claim.

We are not liable for the actions, omissions, services, or advice of any broker listed on the Site. Your relationship with any broker is independent of CustomsBrokerIndex.

11. Analytics, Tracking, and Visitor Identification

By using this Site, you acknowledge that we operate as a B2B directory and use industry-standard tools to understand how trade professionals and businesses interact with our content. These tools include website analytics (Google Analytics, PostHog, Ahrefs) and B2B visitor identification services (RB2B, Apollo.io) that may associate your visit with your professional identity — such as your name, employer, and business email — based on your IP address or browser signals.

This is standard practice on B2B websites and is used solely to understand our audience and follow up with relevant information about our directory services. We do not use this information for consumer advertising or sell it to third parties.

For material changes affecting paid Advertising Services, we will provide at least 14 days' advance notice by email.

These Terms are governed by the laws of the United States. Any disputes arising from your use of the Site or Advertising Services shall be resolved through good-faith negotiation, or, failing that, through binding arbitration under applicable rules.
